SHORT-TERM STAY

  1. The foreigner is allowed to stay on the Czech republic territory for a period determined by the visa; if it is not necessary for the document to be accompanied by the visa, then for a period determined by the Government of the Czech Republic or by an international agreement covenant for the Czech Republic.
  2. The short-term stay is allowed for maximum 180 days. If the short-term stay is allowed for a period shorter than 180 days, it can be extended on a foreigner's request by the Service of Alien and Border Police.
  3. The foreigner has a duty to ask for the stay extension not later than 3 working days before the date of expiration.
  4. The time for a period of runs from the time and day of crossing of the Czech Republic border; this time is mentioned in a stamp given by the Service of Alien and Border Police body on the border crossing.
  5. Visa for a short-term stay is granted on a foreigner's request abroad by the Diplomatic Mission or by the Consulate Office of the Czech Republic and on the Czech Republic territory by the Service of Alien and Border Police.
  6. The foreigner asking for a short-term stay has duty to submit on a request together with the application document acknowledging disposition of means for the stay and departure from the Czech Republic territory.
  7. Authority competent to grant the short-term visa can for granting put a condition to deposit a financial amount necessary for expenditures related to departure of a foreigner from the Czech Republic abroad. If the foreigner leaves the country without using this this financial amount, this will be returned to him/her.

APPLICATION FOR LONG-TERM STAY ON THE CZECH REPUBLIC TERRITORY

The foreigner's application for permission of a long-term stay must be accompanied by:

  1. the Form "Application for long-term / permanent stay on the CR territory" filled in either by typewriter other by block letters.
     
  2. 3 photos (passport size).
     
  3. Available travel document the validity of which is 60 days longer than supposed last day of the stay permission; the travel document isn't allowed to be an identification card that doesn't allow to make official remarks. The citizens of Slovakia can use their identification cards.
     
  4. A statement from the Czech Republic Criminal Record Register, Soudní 1, 140 66 Praha 4.
      
  5. A statement from the criminal record register or by similar document not older then 180 days from the country of citizenship; or if he/she doesn't have permanent stay in the country of citizenship the application must be accompanied by a criminal record statement from the country of permanent stay, and it must be in original and Czech translation.

    The original will be superlegalized by the accepting authority representing the Czech Republic abroad.

    The superlegalization isn't necessary if it is determined by the agreement.

    The translation will be made abroad either by the Czech Republic representing authority or by legal translator.

    If the application isn't accompanied by this document for a reason that the country didn't issue it the application must be accompanied by a statement on clean applicant's criminal record.

  6. A document by which the foreigner proves the aim of a stay. As such document is accepted:
    1. for the aim of employment: verified copy of work permission issued by the Bureau of Employment. For citizens of the Slovak Republic it's a copy of "Registration card by the origin of a reciprocal employment" with a stamp of particular bureau of employment and this also in a case when he/she enters the Czech Republic daily (so called pendlers), the place of his/her stay is the employer's residency on the Czech Republic territory, or
    2. for the aim of study, short-term attachment, medical treatment, lecturing, etc.: verified copy of acceptance for a study, short-term attachment, medical treatment, lecturing, etc., or
    3. for the aim enterpreneur activities:
      - verified copy of a document about interrupted procedure for issuing of a business licence issued by particular business licence bureau (from the document must be clear that the issuing of business licence procedure was interrupted only for a reason that there wasn't any permission to stay, or
      - verified copy of a enterpreneur activity licence, or
      - until the enterpreneur activity licence is issued, the verified copy of an identical business activity notification with proved delivery, or
      - verified copy of licensing charter, or
      - verified copy of registration in the commercial register, or
      - verified copy of an agreement on corporation or notary's office notification on corporation origin, or
    4. for the aim to join the family: if it concerns a spouse, a verified copy of marriage certificate or other document (e.g. birth certificate) certifying the relationship, or
    5. for the aim of charity activity: in case of a foreigner who is its founder it is a verified copy of the charity registration in the place of a particular district authority (in case of other foreigners working with the charity it is a document for the aim of employment).
       
  7. By a document confirming reserved accommodation. Such document is:
    1. verified copy of a contract for taking over a flat, or
    2. verified copy of flat ownership, or
    3. verified copy for leasing of a flat or its part together with verified document on flat renter permission to hire the flat or its part. If the reservation of accommodation is in the case of private ownership doubtful, the foreigner is also asked to submit a statement from the land-register on the flat ownership, or
    4. verified statement of the flat renter on the agreement with foreigner's accommodation. If the reservation of accommodation is doubtful, the foreigner is also asked to submit a statement from the land-register on the flat ownership (if it concerns a flat in private ownership), or for a statement from the housing cooperative (if it concerns a flat in cooperative ownership), or for a statement from the flat owner, i.e. municipality or public authority (if it concerns a flat in the community or state ownership), or
    5. verified notification from accommodation facility about reserved accommodation for a supposed period of permission to stay (student dormitory, public accommodation facility, hotel).
        
  8. By a document by which the foreigner confirms reservation of means for the stay. As such document is accepted:
    1. for the aim of employment - this document replaces the Bureau of Employment decision, or for the Slovak Republic citizens the Registration card;
    2. for the aim to join the family - the document for reservation of means for the stay from the husband business activity (in the amount of minimum salary for a month and person); from the own property or from the husband property (husband's statement on disposition right for his wife); or from other own means, i.e. bank account statement with the amount on the level of minimum salary for a month and person in the total amount of at least 1 year of stay, or
    3. for other aim - if the reservation of means isn't clear from the document about the aim of stay, document about reservation of means for the stay from own means, i.e. bank account statement with the amount on the level of minimum salary for a month and person in the total amount for at least one year of stay.
        
  9. A decision stating the refugee status withdrawal if it concerns a foreigner to whom was granted the refugee status on the Czech Republic territory.

The submitted documents, with exception of birth register and travel documents, aren't allowed to be older than 180 days. International documents must be accompanied by an official translation to the Czech language.

The authority of the Alien and Border Police can ask according to 32 chap.2 of the Law No.71/1967 Dig. on administrative procedure (administration code) for other documents that can have influence on the decision on the permission of stay.

APPLICATION FOR PERMANENT STAY ON THE CZECH REPUBLIC  TERRITORY

The foreigner's application for permission of a permanent stay must be accompanied by:

  1. the Form "Application for long-term / permanent stay on the CR territory" filled in either by typewriter other by block letters.
      
  2. 3 photos (passport size).
      
  3. Available travel document; the travel document isn't allowed to be an identification card that doesn't allow to make official remarks. The citizens of Slovakia can use their identification cards.
      
  4. A statement from the Czech Republic Criminal Record Register, Soudní 1, 140 66 Praha 4.
      
  5. A statement from the criminal record register or by similar document not older then 180 days from the country of citizenship; or if he/she doesn't have permanent stay in the country of citizenship the application must be accompanied by a criminal record statement from the country of permanent stay, and it must be in original and Czech translation.

  6. A document by which the foreigner proves the aim of a stay. As such document is accepted a verified copy of marriage certificate if it concerns a spouse, or other document (e.g. birth certificate) that shows clearly the relationship mentioned in 7 of the Law No.123/1992 Dig. in the sense of later provisions, on the stay of foreigners on the territory of the Czech and Slovak Federative Republic.
      

  7. By a document by which the foreigner confirms reservation of means for the stay. As such document is accepted:
    1. a verified statement of the husband, grandparent, child, grandson, sister or brother in the Czech Republic that he/she shall provide the applicant with material security for the whole period of his/her stay, or
    2. a notification of any financial institution showing a transfer of rent, savings, bank account, etc. in the Czech Republic; to acknowledge this, the foreigner has to submit a statement showing that he/she has means in the amount of minimum salary for one month and person in the total amount for at least 5 years ot the stay, or
    3. a reliable confirmation that his/her social pension being sufficient for social security will be transfered to the Czech Republic, or
    4. a verified copy of employment permission issued by the Bureau of Employment (citizen of the Slovak Republic a copy "Registration card by the origin of a reciprocal employment" with a stamp of particular bureau of employment).
        
  8. By a document confirming reserved accommodation. Such document is:
    1. verified copy of a contract for taking over a flat, or
    2. verified copy of flat ownership, or
    3. verified copy for leasing of a flat or its part for a minimum period of 5 years. If the reservation of accommodation is in the case of private ownership doubtful, the foreigner is also asked for submitting an excerpt from the land-register about the ownership of a flat, or
    4. verified statement of the flat renter about the agreement on accommodation of a foreigner for minimum of 5 years. If the reservation of accommodation is doubtful, the foreigner is also asked to submit an excerpt from the land-register about the ownership of a flat (if it concerns a flat in private ownership), or for a statement of the housing cooperative (if it concerns a flat in cooperative ownership), or for a statement of the flat owner, i.e. municipality or public authority (if it concerns a flat in the community or state ownership).
         
  9. A decision stating the refugee status withdrawal if it concerns a foreigner to whom was granted the refugee status on the Czech Republic territory.

Citizen of the Slovak Republic being recorded for a permanent stay on the Czech Republic territory by December 31, 1992 and this stay continues, submits only filled-in application for permission of a permanent stay on the Czech Republic territory, 3 photos, and available travel document.

The submitted documents, with exception of birth register and travel documents, aren't allowed to be older than 180 days. International documents must be accompanied by an official translation to the Czech language.

The authority of the Alien and Border Police can ask according to 32 chap.2 of the Law No.71/1967 Dig. on administrative procedure (administration code) for other documents that can have influence on the decision on the permission of stay.

EXTENSION OF LONG-TERM STAY PERMISSION AND VALIDYTY OF DOCUMENT FOR PERMISSION OF STAY FOR A FOREIGNER IF IT CONCERNS A PERMANENT STAY

  1. The application for extension of a period determined by the permission for long-term stay, and if this concerns a permanent stay the application for extension of a validity for the Card for permission of stay for a foreigner, must be submitted in a time limit determined by the law (not later than 14 days before expiry date - 10 chap.4 of the Law No.123/1992 Dig.) to the authority of the Alien and Border Police where is the foreigner registered either for long-term or permanent stay.
       
  2. If it concerns a long-term stay, the foreigner must present the same documents as by granting of this stay plus the Card for permission of stay for a foreigner, with exception of the criminal record or similar document from the country of citizenship, or if he/she doesn't have permanent stay in the country of citizenship from the country of his/her permanent stay.
      
  3. If it concerns a permanent stay, the foreigner shall submit a valid travel document and a Card for permission of stay for a foreigner.
      
  4. The authority of the Alien and Border Police can ask for other documents necessary for the decision according to 32 chap.2 of the Law No.71/1967 Dig. on administration decision according to 32.

VERIFICATION OF INVITATION

The authority of the Alien and Border Police Service shall verify the invitation for a citizen of the Czech Republic older than 18 years who is reported for a permanent stay on the Czech Republic territory, or this shall be verified for a foreigner older than 18 years who has a permission for long-term or permanent stay or to whom was granted a refugee status on the Czech Republic territory.

The authority of the Alien and Border Police Service shall verify the invitation even in such a case when the invited person is from Belorussia, Kazakhstan, Kyrgystan, Moldavia, Turkmenia, Ukraine and the inviting person is a citizen of the same county older than 18 years who has a permission for permanent or long-term stay from the service, study or medical treatment reasons not shorter than 3 months, i.e. the citizen of Belorussia is invited by the citizen of Belorussia, etc.

If the invitation for visit of the Czech Republic is verified for a service aim for an enterprise (company), every invitation must be accompanied by a verified copy from the commercial register or by business licence or by a similar document that proves the existence of this enterprise and the reason of the visit. In case of representation by a person mentioned in the commercial register or in the business licence every invitation must be accompanied by affidavit verified by notary's office (by every invitation).

The application for extension of stay must be submitted according to the Law No.123/1992 Dig. at least 14 days before expiry date of the Card for permission of stay for a foreigner. Non-compliance of this instruction will be considered in the framework of transgression proceedings and can result in a fine.

According to 10 chap.4 of the Law No.123/1992 Dig. it is necessary to ask for the change within 3 working days of the change. Non-compliance of the time limit to submit the application to issue a substitute card will be considered in the framework of transgression proceedings and can result in a fine.
